Legal Framework for Drugs in Thailand

Drug enforcement in Thailand is primarily guided by:

  • The Narcotics Act, B.E. 2522 (1979)

  • The Psychotropic Substances Act, B.E. 2518 (1975)

  • Measures for Suppressing Narcotic Offenders Act, B.E. 2534 (1991)

  • The new Narcotics Code, which reinforces controls over both trafficking and consumption


These laws criminalize possession, use, trafficking, and production of controlled substances. Penalties are rigorous, and legal authorities strictly enforce compliance for both Thai nationals and foreigners.

Categories of Controlled Substances

Psychotropic Substances

Defined under the Psychotropic Substances Act, these include natural or synthetic chemicals listed by the Minister. They are grouped into four schedules:

  • Schedule I: No accepted medical use, high potential for abuse

  • Schedule II: Recognized medical use, potential for abuse

  • Schedule III: Medical use with moderate abuse risk

  • Schedule IV: Medical use with lower abuse potential

Narcotics

The Narcotics Act defines narcotics as substances that can significantly alter physiological or mental functions, potentially causing dependency or health deterioration. They include both natural derivatives and chemicals used to manufacture drugs, categorized into five classes:

  • Category I: Highly dangerous narcotics (e.g., heroin)

  • Category II: Common narcotics (e.g., codeine, cocaine, morphine, medicinal opium)

  • Category III: Medicinal narcotics containing Category II ingredients

  • Category IV: Chemicals for producing Category I or II narcotics

  • Category V: Other narcotics not included in I–IV


The Minister publishes the official list of narcotics, and certain substances, including medicinal opium, are regulated strictly for authorized medical purposes.

  • Avoid carrying packages or substances for others, as this may be considered trafficking.
