Child abduction is treated as a grave criminal offense under Section 313 of the Thai Criminal Code. The law addresses situations in which a person unlawfully removes, restrains, or detains a child or young individual, particularly when done to demand ransom or through coercion. Key points include:

  • Offenses involving children under fifteen years of age or persons over fifteen obtained through deceit, threats, violence, or undue influence are punishable by 15–20 years imprisonment, fines of 30,000–40,000 Baht, or potentially life imprisonment or the death penalty.

  • If the act results in serious injury, torture, or psychological harm, the offender may face life imprisonment or death. Death caused by the act is punishable by death.

  • Accomplices and intermediaries are also held liable:

    • Section 314 applies to those supporting the crime, who face the same penalties as the primary offender.

    • Section 315 applies to those demanding or accepting ransom, with sentences of 15–20 years, fines, or life imprisonment.

Parental Abduction

Disputes between parents regarding child custody are handled differently:

  • Taking one’s own child without the other parent’s consent is usually treated as a civil matter, provided it does not violate a sole custody order.

  • In cases where a child is taken abroad, the left-behind parent must obtain legal recognition of custody through a Thai court before pursuing the child’s return.

International Framework: Hague Convention

Thailand is a signatory to the 1980 Hague Convention on the Civil Aspects of International Child Abduction, which provides mechanisms for:

  • Prompt return of abducted children across borders

  • Protecting visitation and parental access rights

  • Preventing wrongful retention of children in foreign countries


The Hague Convention only applies if both involved nations are signatories. Domestic parental disputes typically fall outside its scope and are generally resolved through civil procedures.
